PIPEDA Compliance

The Personal Information Protection and Electronic Documents Act (PIPEDA) is Canada’s federal private‑sector privacy law. It sets rules for how organizations collect, use, and disclose personal information in the course of commercial activities. PIPEDA compliance means putting policies, processes, and safeguards in place to protect personal information and respect individuals’ privacy rights.

Who Needs PIPEDA Compliance

  • Canadian private‑sector organizations engaged in commercial activities
  • Companies based outside Canada that collect or process personal information about individuals in Canada in the course of doing business
  • E‑commerce and online services targeting Canadian customers
  • Financial, insurance, telecom, and other service providers handling customer data
  • Service providers that process personal information on behalf of Canadian organizations

Risks of Not Being Compliant

  • Investigations and findings from the Office of the Privacy Commissioner of Canada (OPC)
  • Orders to change practices, update safeguards, or stop certain data uses
  • Potential civil liability and class‑action lawsuits after privacy incidents or data breaches
  • Reputational damage and loss of customer trust following negative findings or publicized breaches
  • Lost business opportunities where strong privacy compliance is a customer or partner requirement
